The prosecution alleged that our client committed felonious assault, pointing to the serious injuries sustained by the complaining witness as evidence of the severity of the incident.
Our client maintained from the outset — including in his statement to arresting officers — that he had not assaulted the victim at all, and that he had only intervened in an attempt to break up the altercation between other parties.
At trial, defense counsel focused on establishing our client’s credibility with the jury, walking them through the consistency of his account from the moment of arrest through trial testimony. Despite the undisputed severity of the victim’s injuries, the jury found our client’s version of events persuasive and returned a verdict of Not Guilty on the felonious assault charge.
