Following a search that led to a felony drug possession charge, our client faced allegations that she unlawfully possessed a controlled substance.
Defense counsel challenged the legality of the search itself, filing a motion to suppress and arguing at hearing that the search had not been consensual and therefore violated our client’s constitutional rights.
The court agreed, ruling that the search was not conducted with valid consent and suppressing the drug evidence from trial. Without the physical evidence, the State could not sustain its case, and the felony possession charge was dismissed.
